These terms and conditions govern the use of the "ShulRanking" service (hereinafter referred to as "the
Service"). Please use the Service after agreeing to these terms.
Article 1 (Definitions)
The definitions of terms used in these terms and conditions are as follows:
- Service: The service operated by us and related services
- Website: The website where the Service's content is published
- Content: The collective term for text, sound, still images, videos, software programs, code, etc. provided on
the Service (including posted information)
- User: All individuals who use the Service
- Registered User: Individuals who have completed user registration for the Service
- ID: A unique string of characters that a Registered User has for using the Service
- Password: A unique encryption set by a Registered User corresponding to their ID
- Posting: The act of a Registered User publishing rankings, text, strings, images, comments, etc.
- Posted Information: The collective term for information such as rankings, text, strings, images, comments,
etc. published by Registered Users through posting
- Personal Information: The collective term for information that can identify an individual, such as address,
name, occupation, phone number, etc.
- Registration Information: The collective term for information registered by Registered Users in the Service
(excluding posted information)
- Intellectual Property: Inventions, ideas, new plant varieties, designs, works, and other things created
through human creative activities (including discoveries or elucidations of natural laws or phenomena that have
industrial applicability), trademarks, trade names, and other things used to indicate goods or services in
business activities, as well as trade secrets and other technical or business information useful for business
activities
- Intellectual Property Rights: Rights prescribed by laws and regulations concerning intellectual property or
rights related to legally protected interests, including patent rights, utility model rights, breeder's rights,
design rights, copyrights, trademark rights, and other rights
Article 2 (Agreement to Terms)
The Service uses users' personal information for the following purposes.
- Users may use the Service after agreeing to these terms of use.
- When a user downloads the Service to a smartphone or other information terminal and completes the agreement
procedure for these terms, a usage contract is established between the user and us in accordance with the
provisions of these terms.
- If a user is a minor, please use the Service after obtaining the consent of a parent or other legal
representative.
- If a minor user uses the Service by falsely claiming to have parental consent or by falsely claiming to be an
adult, or by using deception to make it appear that they are a person with legal capacity, they cannot cancel
any legal acts related to the Service.
- When a user who was a minor at the time of agreeing to these terms uses the Service after reaching adulthood,
that user is deemed to have ratified all legal acts related to the Service.
Article 3 (Changes to Terms)
- We may revise the content of these terms at any time without the user's consent, and the user shall accept
this without objection.
- When we revise these terms, we will notify users of the content through our prescribed method.
- The effect of the revision of these terms shall take effect from the time we provide the notification in the
preceding paragraph.
- Users shall be deemed to have agreed without objection to the revised terms of use when they use the Service
after the terms have been changed.
Article 4 (Account Management)
- Users shall register and manage information registered for use (hereinafter referred to as "Registration
Information," including email addresses, IDs, passwords, etc.) at their own discretion and responsibility. Users
shall not allow third parties to use this information or lend, transfer, change names, buy, or sell it.
- We may treat the use of the Service through Registration Information as use by the person who completed the
user registration, and all results arising from such use and all responsibility accompanying it shall belong to
the person who completed the user registration.
- Users shall compensate us and third parties for any damage caused by improper use of Registration Information.
- Management of Registration Information shall be performed by users at their own responsibility, and we shall
not be responsible for any disadvantages or damages suffered by users due to Registration Information being
inaccurate or false.
- We may delete accounts and data associated with accounts that have not been accessed for one year or more
without prior notice to users.
- All usage rights of users in the Service shall expire at the time the account is deleted, regardless of the
reason. Please note that even if a user accidentally deletes their account, the account cannot be restored.
- The Service account belongs exclusively to the user. All usage rights of users in the Service cannot be
transferred, lent, or otherwise disposed of to third parties or inherited.
- If it becomes clear that Registration Information has been stolen or is being used by a third party, users
shall immediately notify us of this fact and follow our instructions.
Article 5 (Handling of Personal Information)
Personal information and user information shall be handled appropriately in accordance with our separately
established "Privacy Policy."
Article 6 (Prohibited Acts)
In using the Service, we prohibit users (hereinafter referred to as "Users") from the following acts. If we
determine that a user has violated these prohibited acts, we may take measures we deem necessary, such as
suspending use or deleting posts, and users shall accept this without objection.
- Acts that infringe on our or third parties' intellectual property rights
- Acts that damage our or third parties' reputation or credit, or unjustly discriminate against or slander them
- Acts that infringe on our or third parties' property, or acts that may infringe on it
- Acts that cause economic damage to us or third parties
- Acts that threaten us or third parties
- Users posting the following information:
① Information that poses a risk of damage to third parties'
rights and property
② Information that is harmful to third parties, information that physically or psychologically harms third
parties
③ Information that constitutes crimes or illegal acts, dangerous acts, or information that incites or aids
such acts
④ Information intended to be illegal, harmful, threatening, abusive, racist, defamatory, insulting,
harassing, inciting, or causing discomfort, or information that may result in such outcomes
⑤ Information that is contrary to facts or known to be non-existent
⑥ Information that users do not have the right to control
⑦ Information that infringes on third parties' intellectual property rights including copyrights and other
property rights, information that infringes on public interests or individual rights
⑧ Information such as images or documents that constitute obscenity, child pornography, or child abuse
⑨ Information that violates laws such as the Medical Practitioners' Act
⑩ Other information that we deem inappropriate
- Using computer viruses or harmful programs, or inducing such use
- Acts that place excessive stress on the Service's infrastructure
- Attacks on our website's servers, systems, or security
- Attempting to access the Service through methods other than the interface provided by us
- One user obtaining multiple user IDs
- Acts that interfere with the Service's servers or network systems
- Using bots, cheat tools, or other technical means to improperly manipulate the Service
- Intentionally exploiting Service malfunctions
- Making unreasonable inquiries or demands to us, such as repeatedly asking the same questions unnecessarily
- Other acts that interfere with our operation of the Service or other users' use of the Service, or cause
problems for these
- Other acts that we deem inappropriate
Article 7 (Handling of Content)
- Users may use the Service's content only within the scope determined by us.
- All rights related to all content provided by the Service belong to us, and we do not grant users any license
to implement or use the patent rights, utility model rights, design rights, trademark rights, copyrights, or
other intellectual property rights that we possess.
- Users are prohibited from reproducing, transmitting, transferring (including buying and selling between
users), lending, translating, adapting, unauthorized reprinting, secondary use, commercial use, modification,
reverse assembly, reverse compilation, reverse engineering, etc. of the content by any method beyond the scope
of use determined by us.
- Notwithstanding the preceding paragraph, if a user loses their user qualification due to withdrawal, etc., the
right to use the provided content shall also expire.
- Copyrights (including all copyrights stipulated in Articles 21 to 28 of the Copyright Act) related to content
that users send through posting or other methods on the Service (still images, videos, text information, and all
other information) shall belong to the users. However, users grant us a non-exclusive, royalty-free license to
use such content within and outside Japan at the time of sending the content.
- Users shall not exercise moral rights in the Service.
- Users shall back up posted content themselves. We are not obligated to back up posted content.
Article 8 (Disclaimer)
- We shall not be liable for any damages arising from changes, interruptions, or termination of the Service's
content.
- We shall not be involved in or liable for users' Service usage environment.
- We do not guarantee that the Service will meet users' specific purposes, have the expected functions,
commercial value, accuracy, usefulness, that users' use of the Service will comply with applicable laws or
internal rules of industry groups, or that there will be no malfunctions.
- We do not guarantee that the Service will be compatible with all information terminals, and users shall
acknowledge in advance that malfunctions may occur in the Service's operation due to OS version updates, etc. of
the information terminals used for the Service. We do not guarantee that such malfunctions will be resolved
through program corrections, etc. made by us.
- Users shall acknowledge in advance that the use of all or part of the Service may be restricted due to changes
in the terms of use and operation policies of service stores such as AppStore and GooglePlay.
- We shall not be liable for any damages, direct or indirect, incurred by users as a result of using the
Service.
- We shall not be liable for any damages (including indirect damages and lost profits) such as lost
opportunities or business interruptions incurred by users or other third parties, even if we were notified in
advance of the possibility of such damages.
- When there is a request for deletion of a post from another user or a third party, we may determine whether to
delete it at our discretion, and we shall not be liable for any responsibility arising from such determination.
- The provisions of paragraphs 1 through the preceding paragraph shall not apply if we have acted intentionally
or with gross negligence, or if the contract is with a consumer under the Consumer Contract Act.
- Even if the preceding paragraph applies, we shall not be liable for any damages incurred by users due to
negligent acts (excluding gross negligence) that arise from special circumstances.
- If we are liable for damages related to the use of the Service, our liability shall be limited to the amount
received from the user in the month in which the damage occurred.
- We shall not be liable for any disputes or troubles between users and other users. If a user has a trouble
with another user, it shall be resolved between the two parties, and no claims shall be made against us.
- If a user causes damage to another user or has a dispute with a third party in relation to the use of the
Service, the user shall compensate for such damage or resolve such dispute at their own expense and
responsibility, and shall not cause any trouble or damage to us.
- If we receive a claim for damages, etc. from a third party due to a user's actions, the user shall resolve
this at their own expense (including attorney's fees) and responsibility. If we pay damages to such third party,
the user shall pay us all expenses (including attorney's fees and lost profits) including such damages.
- If a user causes damage to us in relation to the use of the Service, the user shall compensate us for the
damage (including litigation costs and attorney's fees) at their own expense and responsibility.
- We do not guarantee the accuracy of information posted by other users on the Service. We shall not be liable
for any disputes or troubles related to information published on the Service.
- We do not guarantee, either expressly or impliedly, that the Service (including the Content) is free from
defects (including security-related defects, errors, bugs, and rights infringements), or that it is safe,
reliable, accurate, complete, effective, and suitable for specific purposes. We are not obligated to provide the
Service by removing such defects.
Article 9 (Regarding Advertisement Display)
Users shall be deemed to understand and agree that the Service may contain various advertisements and that we or
our partners may display various advertisements. The form and scope of advertisements on the Service may be
changed by us from time to time.
Article 10 (Prohibition of Rights Transfer)
- Users shall not transfer their status under these terms or all or part of their rights or obligations based on
these terms to a third party without our prior written consent.
- We may transfer all or part of the Service to a third party at our discretion, and in such case, all of the
user's rights related to the Service, including the user's account, shall be transferred to the transferee
within the scope of the transferred rights.
Article 11 (Severability)
If any provision or part of these terms is determined to be invalid or unenforceable under the Consumer Contract
Act or other laws and regulations, the remaining provisions of these terms and the remaining parts of the
provision determined to be invalid or unenforceable shall continue to be fully effective.
Article 12 (Contact Method with Us)
Users' contact and inquiries to us regarding the Service shall be made through the inquiry form set up in an
appropriate location on the Service or our website, or through other methods separately specified by us.
Article 13 (Governing Law)
The Service shall review the operational status of personal information handling from time to time and strive
for continuous improvement, and may change this Privacy Policy as necessary.
